Terms of Service

1. Acceptance of Terms
By accessing or using MusicalRPM.com and any associated services or platforms (collectively, the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree to these Terms, please discontinue use immediately.
2. Eligibility
To use Musical RPM:
- You must be at least 18 years old, or have consent from a parent or legal guardian.
- You must comply with all applicable local, national, and international laws and regulations.
3. User Accounts
Account Creation: You must provide accurate, up-to-date information during the sign-up process.
Account Security: You are responsible for maintaining the confidentiality of your login credentials.
Termination: Musical RPM reserves the right to suspend or terminate accounts at our sole discretion for violations of these Terms.
In cases of termination for breach, fraud, or violation of these Terms, you will forfeit any unpaid earnings. In cases of termination without cause, you will remain entitled to any undisputed earnings accrued up to the date of termination.
4. Intellectual Property
All content on MusicalRPM.com—including logos, images, designs, copy, and technology—is the intellectual property of the owners of MusicalRPM.com and protected under applicable copyright and trademark laws.
You may not copy, reuse, reproduce, or modify our content without prior written permission.
5. Revenue Models and Payments
Musical RPM offers two earning models:
- Sponsorship Model: Upfront payments made within 7 days for qualified content, based on projected performance. Qualified content must be pre-approved by Musical RPM before publishing. Payment will only be made for content that, once published, meets the minimum performance projection agreed upon between Musical RPM and the partner prior to publication.
- Revenue Share Model: Ongoing earnings based on actual royalties received from YouTube. Payouts follow a Net-90 timeline.
Estimated Revenues
Revenue estimates shown in your dashboard are not guaranteed. Final payouts are based solely on royalty reports received from YouTube, which typically arrive within 90 days of content publishing. You will receive your final confirmed payout amount before any funds are issued. Any validated views shown in your account will count towards your Payment Threshold, but any funds will be manually reviewed by our team before totals are finalised.
Payment Threshold
You must have a minimum unpaid balance of $20 USD in your account to request a payout.
Payment Methods
We currently support payments via:
- PayPal
- Bank Transfer (ACH or Wire Transfer)
6. Payment Terms and Conditions
- Payments are issued on a Net-7 (Sponsorship Model) or Net-90 (Revenue Share Model) basis, depending on your selected agreement.
- All payment timelines are estimates, not guarantees.
- Musical RPM will not pay interest on late payments.
- Delays may occur due to reasons beyond our control, including but not limited to:
- Late payments or reporting by YouTube
- Banking system delays or errors
- Technical interruptions
All determinations regarding partner eligibility, revenue calculations, and payouts are made at the sole discretion of Musical RPM and shall be final and binding.
No Payment if No Revenue is Received
If YouTube does not pay us for a video you created using our music, we will not be able to pay you. This includes, but is not limited to, YouTube’s system failing to detect our music in your video (this is why we recommend at least 15% volume and a 35+ second video), YouTube terminating your account.
It is your responsibility to ensure your content complies with YouTube’s terms, monetization policies, and community guidelines. Violations may result in withheld royalties, in which case Musical RPM bears no obligation to compensate you.
Fraud and Abuse
Any attempt to circumvent our systems or YouTube’s systems will result in immediate termination of your account and forfeiture of any monies owed to you. This includes, but is not limited to:

Artificially inflating views or engagement metrics

Generating or purchasing bot traffic, low-quality traffic, or unusual traffic (as these can affect our payments)

Misrepresenting ownership of a channel

Uploading content that violates YouTube’s policies or these Terms

Using multiple songs in a single video

Uploading videos where our music is not reasonably audible (we recommend a minimum length of 35+ seconds and a minimum volume of 15%)
Re-uploading older content is permitted only if the video has been transformed (e.g., edited, remixed, or otherwise substantially changed). Non-compliance may result in forfeiture of earnings.
Audit Rights
Musical RPM reserves the right to review, investigate, and audit partner accounts to ensure compliance with these Terms and YouTube’s policies. We may request additional information, including video links or channel analytics, and failure to cooperate may result in payment delays or account termination.
Currency and Fees
Payments are issued in U.S. Dollars (USD) by default. All bank transfer fees, PayPal fees, and other applicable charges will be deducted from your payout. If payment in USD is not suitable in your country, you may contact us. At our sole discretion, we may approve an alternative payment method or currency on a case-by-case basis.
Payment Details
It is your responsibility to ensure that all payment information provided in your account is accurate and up to date. If a payment is issued in accordance with the details you have supplied, it will be considered final and settled. Musical RPM is not responsible for losses arising from incorrect or outdated payment details.
Taxes
Partners are independent contractors and are solely responsible for reporting and paying any applicable taxes, duties, or charges arising from their earnings. Musical RPM will not withhold taxes on your behalf unless required by law.
Account Connectivity
Your YouTube channel(s) must remain connected to your Musical RPM account to allow accurate tracking of your earnings. Channels may, on occasion, disconnect automatically due to reasons outside of our control. While this typically does not occur more than once per year (unless you are testing beta features), we strongly recommend logging in at least once per month to review your account status and ensure all channels remain connected. If your channel(s) are disconnected, we cannot guarantee accurate revenue tracking, and this may result in payment delays or forfeiture of certain payouts.
7. Privacy and Data
By using Musical RPM, you consent to the practices outlined in our Privacy Policy. This includes how we collect, use, and store your personal information.
8. Prohibited Conduct
You agree not to:
- Upload or promote illegal or infringing content
- Manipulate video views or engagement metrics
- Misuse or reverse-engineer any part of our platform
- Violate YouTube’s policies, terms of service, or community guidelines
- Use our music in a way that breaches your licensing agreement
9. Channel Eligibility
To qualify for monetization via either model:
- Your channel must contain at least 1 YouTube Shorts video
- Content must be original and comply with YouTube’s policies
- You must own or manage the channel submitted
- Content must not include hate speech, graphic violence, or explicit material
Violation of these criteria may result in rejection, removal from the platform, or forfeiture of payouts. Acceptance into the Partner Program is at the sole discretion of Musical RPM. We reserve the right to reject or remove partners at any time, with or without cause. We also reserve the right to modify or discontinue the Partner Program or any of its components at our discretion.
10. Indemnification
You agree to indemnify, defend, and hold harmless MusicalRPM.com, its owners, affiliates, officers, and employees from and against any and all claims, demands, damages, liabilities, losses, costs, and expenses (including reasonable legal fees and fines) arising out of or related to:

Your breach of YouTube’s guidelines, terms of service, or community policies

Your infringement, or alleged infringement, of any copyright, trademark, or other intellectual property rights

Your use of any third-party content, including copyrighted materials, that you do not have the legal right or license to use
You are solely responsible for ensuring that all content you upload or distribute using our Services complies with applicable laws, including copyright and intellectual property laws. You must only use materials (including video, audio, images, and other content) for which you hold sufficient rights or licenses. If you are uncertain about whether your use of a work qualifies as fair use or falls within other legal protections, it is your responsibility to seek independent legal advice before publishing.
If any third party brings a claim, lawsuit, or enforcement action against Musical RPM arising from your conduct, content, or use of our Services, you agree to assume full responsibility, including covering all associated damages, settlements, legal fees, and costs.
11. Limitation of Liability
To the fullest extent permitted by law, the total liability of MusicalRPM.com, its owners, affiliates, officers, and employees for any claim arising out of or relating to these Terms or the Services shall be limited to the total amount paid to you in the 12 months preceding the event giving rise to the claim.
Musical RPM shall not, under any circumstances, be liable for:

Any claims, actions, damages, or losses arising from your own conduct, including but not limited to infringement of third-party rights, violation of laws, or breach of YouTube’s policies

Loss of income due to third-party decisions (e.g., YouTube demonetization, strikes, account suspension, or takedowns)

Inaccuracies in estimated earnings or reporting delays by YouTube

Delays caused by banks, payment providers, or technical interruptions outside of our control

Indirect, incidental, special, or consequential damages, including lost profits, even if we have been advised of the possibility of such damages
You acknowledge and agree that you bear sole responsibility for your own content and compliance with applicable laws. Musical RPM provides no guarantee or warranty regarding your eligibility for monetization, the legality of your content, or the outcome of any disputes with third parties.
Force Majeure
Musical RPM shall not be held liable or responsible for any failure or delay in performance caused by circumstances beyond our reasonable control. This includes, but is not limited to, acts of God, natural disasters, government actions, labor disputes, power outages, internet or telecommunications failures, service interruptions, or changes to YouTube’s policies, systems, or monetization programs.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be handled by the courts of Nottingham, United Kingdom.
13. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted to this page with a new effective date. It is your responsibility to review the Terms regularly. Continued use of our Services constitutes your acceptance of any changes.
